This Privacy Policy applies to Alivenet Solution, LLC dba Alivepbx (“Alivenet”), and governs you’re your collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Alivenet include Alivenet’s website, mobile applications, platforms, media forms or media channels (collectively the “Site”) and Alivenet Solution, LLC.Alivenet provides a call tracking and telecommunications platform through a Software as a Service model (“SaaS”). At Alivenet, the privacy and security of our customers and consumers are of the utmost importance. Alivenet is committed to protecting and securing the data that you share with us.

 

Collection and use of Personal Data

Alivenet processes information that can be used to directly or indirectly identify an individual (“Personal Data”) collected through the use of its website and platform. Any Personal Data stored on Alivenet is treated as confidential subject to the terms herein.

For the purpose of this policy, Alivenet defines the term “User” as an entity with which Alivenet has an established relationship, the term “Consumer” as any individual who calls a phone number issued by Alivenet, and the term “Visitor” as an individual that visits our front-end website, or a website with our JavaScript tags placed on it. (for example: www.Alivenet.com). Alivenet implements and maintains industry standard and state of the art technical, security, and organization measure to protect Personal Data against unauthorized or unlawful processing and use, and against accidental loss, destruction, damage, theft, or disclosure.

Alivenet may share data with trusted partners to help perform statistical analysis, send you emails, provide customer support, or facilitate other uses of the Site. All such third parties are prohibited from using your personal information except to provide these services to Alivenet, and they are required to maintain the confidentiality of your information.

Alivenet may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Alivenet or the site; (b) protect and defend the rights or property of Alivenet; and/or (c) act under exigent circumstances to protect the personal safety of users of Alivenet, or the public.

Alivenet may keep track user behavior and habits within the Site in order to determine metrics such as what Alivenet services are the most popular. This data is used to deliver customized content and advertising within Alivenet to customers whose behavior indicates that they are interested in a particular subject area.

Alivenet will not retain data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations. For Consumer data, Alivenet’s Users have control of the purpose for collecting data, and the duration for which the Personal Data may be kept. For Consumer data, Users with an active account will therefore have the responsibility to delete data when required. When a user’s account is terminated or expired, all Personal Data collected through the platform will be deleted, as required by applicable law.

Information about your computer hardware and software may be automatically collected by Alivenet. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Alivenet website.

The Alivenet website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Alivenet pages, or register with Alivenet site or services, a cookie helps Alivenet to recall your specific information on subsequent visits. Visitors

If you are a Visitor to our website only, and not a Consumer who has called a phone number controlled by Alivenet or a user of our platform, then this section is relevant for you. If required by applicable law, we will seek your explicit consent to process Personal Data collected on this website or volunteered by you. Kindly note that any consent will be entirely voluntary. Alivenet may collect, record and analyze information of Visitors to its website. We may record your IP address and use cookies. Alivenet may add information collected by way of pageview activity. Furthermore, Alivenet may collect and process any Personal Data that you volunteer to us in our website’s forms, such as when you request a demo or sign up for information and newsletters. If you provide Alivenet with your social media details, Alivenet may retrieve publicly available information about you from social media. Such Personal Data may comprise your IP address, first and last name, your postal and email address, your telephone number, your job title, data for social networks, your areas of interest, interest in Alivenet products, and certain information about the company you are working for (company name and address), the referring site that lead you to our page or a page with Alivenet’s JavaScript placed on it, user agent string, browser type and version, device type, operating system type and version, as well as information as to the type of relationship that exists between Alivenet and yourself. Alivenet may also use your IP address to extrapolate your approximate geographic location, internet service provider, and other location-based data. Alivenet gathers data about visits to the website, including numbers of Visitors and visits, length of time spent on the site, pages clicked on or where Visitors have come from.

Consumers

Consumers should be aware that in calling phone numbers issued by Alivenet, they could be disclosing information that could make them personally identifiable to Alivenet Users. The security and privacy protection implemented on Alivenet’s platform does not cover this type of transfer or disclosure of personal information. Consumers calling a phone number that may be issued by Alivenet and licensed to an Alivenet User should be aware that they are making themselves personally identifiable by their phone number’s ‘Caller ID’ and that they are solely responsible for their actions while on the phone with whatever party they requested to speak with. For more detailed information concerning the protection of privacy when calling an Alivenet issued phone number may contact the entity they requested to speak with. It is the User’s responsibility to ensure that collection and processing of data is done in accordance with applicable law.

If you wish to inquire about your Personal Data that may have been collected in a phone call through Alivenet, we recommend that you contact the entity that you called and spoke with. As Alivenet is a Processor in this regard, it does not control the Personal Data used or stored from the call, but processes it on behalf of its User.

Users

In order to provide services to its Users, Alivenet collects certain types of data from them. Furthermore, Alivenet’s Users collect information from Consumers when call a number issued to an Alivenet User. This section will describe how these two types of data are collected and used by Alivenet as well as geographical differences that effect this policy. Data entered or transferred into Alivenet by Users such as campaign names, target names, publisher names, sub-account information, etc., remains the property of the User and may not be shared with a third party by Alivenet without express consent from the User.

During a User’s registration and later on Alivenet’s platform, they provide information such as name, company name, email, address, telephone, credit-card number and other relevant data. This information is used by Alivenet to identify the User and provide them with support, services, mailings, sales and marketing actions, billing and to meet contractual obligations. Alivenet Users can at any time access and edit, update or delete their contact details by logging in with their username and password to Alivenet’s platform. Alivenet Users may create more Users with different privilege levels within their account. It is the responsibility of the User that creates other User accounts, to choose the level of access each User should have. Once these new Users log into Alivenet, they meet the definition of User in this policy. Alivenet will not retain User data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations.

Collection of Consumer Personal Data

Users may be issued phone numbers to be used on their behalf or by making them available to relevant businesses, organizations, and individuals. It is the User’s responsibility to ensure that collection and processing of data is done in accordance with applicable law. Alivenet will not process Personal Data for other purposes or by other means than instructed by its Users. Consumer data includes data from individuals who called a phone number issued by Alivenet, ‘Caller ID’ numbers from Consumers who may have called, and meta-data collected by Alivenet JavaScript in some cases. Personal Data may include, personal contact information such as IP address, geographic location information such as country, region, city, state, postal code, latitude, and longitude, internet service provider data, referring URLs, browser header data, user-agent strings, device type, browser type, operating system type, phone provider carrier data and other sensitive Personal Data. Consumers may also disclose personal data inside of a call recording, should a User instruct Alivenet to record a call. Call recordings are the property of Alivenet Users and should you have questions about the contents of a call recording, please contact the party in which you called. The purpose of collecting Personal Data as part of a phone call will vary depending on the User, as set up by Alivenet’s Users. As Alivenet provides phone numbers to a wide group of customers and businesses, the purpose may vary greatly. For Users in the EEA, or for Users issued phone numbers in the EEA, the User will be the “controller”, as defined in the Directive and the GDPR. The purpose will consequently be defined by Alivenet’s User. If you or your organization are required under the European Union’s General Data Protection Regulation (GDPR) to enter into a contract, or other binding legal act under EU or Member State law, with your data processors, review and accept Alivenet’s Data Processing Agreement in your Alivenet account.

 

Geographical Location

Alivenet offers a number of data regions. A “Data Region” is a set of data centers located within a defined geographical area where User and Consumer data is stored, maintained by Alivenet or a 3rd party service provider that acts as Alivenet’s data processor. Personal Data is not transmitted between Data Regions. For Alivenet Users with accounts located in Alivenet’s European Data Region, all Personal Data is processed in the EEA. For Users with accounts in the Data Regions: United States of America (US) and Canada, all Personal Data is processed solely in the respective country. For Users with accounts in our Asia Pacific Data Region, all Personal Data is processed in Singapore.

Designated Countries

This Section only applies to Users and Customers of the Services that are located in the European Economic Area, United Kingdom and/or Switzerland (collectively, the “Designated Countries”) at the time of data collection. We may ask you to identify which country you are located in when you use some of the Services, or we may rely on your IP address to identify which country you are located in. Where we rely only on your IP address, we cannot apply the terms of this Section to any User or Customer that masks or otherwise obfuscates their location information so as not to appear located in the Designated Countries. If any terms in this Section conflict with other terms contained in this Policy, the terms in this Section shall apply to Users and Customers in the Designated Countries.

Alivenet processes Personal Data both as a Processor and as a Controller, as defined in the Directive and the GDPR: The Alivenet entity which you as a User entered an agreement with when using Alivenet’s platform, will be the Controller for User data, as outlined above in “Collection of User data” section. For Consumer data, as outlined in the “Collection of Consumer Data” section, the User will be the Controller in accordance with Directive and GDPR, and Alivenet will be the Processor. Alivenet adheres to the Directive of 1995 and the GDPR from May 25th, 2018. Consequently, Alivenet processes all data provided by its Users with accounts in its European Data Region, in the European Economic Area (EEA) only. All data collected by Alivenet Users will be stored exclusively in secure hosting facilities provided by Amazon Web Services, Telnyx, Plivo, and Twilio. Alivenet has a data processing agreement in place with its providers, ensuring compliance with the Directive. All hosting is performed in accordance with the highest security regulations. All transfers of data internally in the EEA is done in accordance with this data processing agreement

You may object to our processing or collecting at any time and as permitted by applicable law if we process your personal information on the legal basis of consent, contract or legitimate interests. We can continue to process your personal information if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.

If we process your personal information based on a contract with you or based on your consent, or the processing is carried out by automated means, you may request to receive your personal information in a structured, commonly used and machine-readable format, and to have us transfer your personal information directly to another “controller”, where technically feasible, unless exercise of this right adversely affects the rights and freedoms of others.

For Users with accounts in the Alivenet North America Data Region, Alivenet processes data solely in data centers located in the US. Alivenet has adopted reasonable physical, technical and organizational safeguards which substantially mirror the EU safeguards against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of the User’s data in Alivenet’s possession. Alivenet will promptly notify the User in the event of any known unauthorized access to, or use of, the User’s data. All data collected by Alivenet Users will be stored exclusively in secure hosting facilities provided by Amazon Web Services, Telnyx, Plivo, or Twilio. Alivenet’s contract with its hosting provider ensures that all hosting is performed in accordance with the highest security regulations. Alivenet’s policy is to protect and safeguard any personal information obtained by Alivenet in accordance with United States state or federal laws governing the protection of personal information and data. Accordingly, Alivenet adheres to practices and policies that aim to safeguard the data.

Other Regions

For Users with accounts in our Asian Pacific Data Region, Alivenet processes data in data centers throughout Asia, and in the US. Alivenet has adopted reasonable physical, technical and organizational safeguards which substantially mirror the EU safeguards against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of the Users data in Alivenet’s possession. Alivenet will promptly notify the User in the event of any known unauthorized access to, or use of, the User’s data. All data collected by Alivenet Users will be stored exclusively in secure hosting facilities provided by Amazon Web Services, Telnyx, Plivo, or Twilio. Alivenet’s contract with its hosting provider ensures that all hosting is performed in accordance with the highest security regulations. Accordingly, Alivenet adheres to practices and policies that aim to safeguard the data.

 

Changes to this Statement

Alivenet reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page.
